What does Canada immigration check when they do a background check?
Background check (BGC) is a procedure to verify the criminal and/or security background of visa applicants to ensure they're admissible to Canada. Background check is a generic term for criminality check, security screening and information sharing. IRCC uses police certificates to find out if you have a criminal record. Applicants must provide criminal record checks from other countries they resided in for six months or more since turning 18 years of age. Your name will be checked against various databases of known criminals or suspects, including the FBI's Universal Index, to check whether there is a match. This includes administrative, applicant, criminal, personnel, and other files compiled by law enforcement.

What is a ghost consultant?
A ghost consultant is someone who is offering immigration assistance with a payment, claiming to be a registered agent with ICCRC. Always check to see if your consultant and their company name can be found on ICCRC official website.

What is Canada’s immigration policy?

Difference between Super visa and Visitor Visa?
Super visa is a stream only for parents and grandparents. Visitor visa, on the other hand, can be to invite anyone to visit Canada. For super visa, the onus is on the Canadian resident to prove financial stability. They will have to meet the LICO chart after calculating number of family members and should have that amount stated in their latest NOA (Notice of Assessment with the Canada revenue Agency). For visitor visa, the onus is on the person visiting, living overseas, to prove that they are financial stability and have reasons to return back to their home country once the visit is over.

Can I bring my spouse to Canada on a Visitor Visa?
2023 brought a lot of changes to Spousal Sponsorship and one of them is to bring your spouse over to Canada, while the application is being processed! We have a very high success rate with this new policy and have been able to reunite spouses in as little as 3 months from when they apply for sponsorship.

Can my spouse work while we await a decision?
Once your spouse has reached Canada through a temporary resident permit (Visitor Visa), you can then apply for an Open Work Permit and they can work!

Is Spousal Sponsorship application online?
Yes, as representatives, we use our online portal which gives access to the client. Once the client reviews all the documents on the portal and signs the declaration, we can then submit the application online.

Can spousal visa be denied?
The point of the spousal sponsorship is to reunite spouses in a genuine marriage/ relationship. If IRCC senses that the relationship is not genuine and is simply for visa purposes, they can deny the case. However, as consultants, we take pride in having a very high success rate in spousal sponsorship and will add even more information then requested to ensure that the genuineness of the relationship is proved.

Can I appeal a refused case?
If you apply to sponsor your spouse who is outside of Canada, you can appeal the refusal!

Can I appeal a refusal to my spousal sponsorship if it is inside Canada?
Unfortunately, when you apply for Spouse in Canada class, you lose your rights to appeal the decision.

Is my spousal sponsorship case stronger if I have children with the other spouse?
Yes, it is! This shows that the relationship is genuine.

Do I need to submit a Police Clearance Certificate if I am applying from inside of Canada?
No, IRCC will request this directly.

How does spousal sponsorship work in Canada?
You can either be in a common law relationship with someone and living together for at least one year or you can be married. Then, there are a number of documents and forms you would submit to prove that your relationship is genuine.

Does it matter how much I claim on my taxes to sponsor my spouse?
No, as long as you are not on and social assistance, you can sponsor your spouse. This seems very confusing to many people but the background for this is that regardless of your financial status, everyone has to rights to spend life with the one they love and as long as you are not a burden on the government, you qualify.

How long is my undertaking if I sponsor my spouse?
The undertaking for sponsoring a spouse is 3 years from the date that your partner becomes a permanent resident.

What is an undertaking when sponsoring someone?
An undertaking is a promise to financially support the sponsored person. This means that you will not allow them to become a burden on the government.

Can I cancel my sponsorship?
If the sponsored person has not received their Permanent Residency, you can cancel your sponsorship application.
